Nebraska Water Users Can Sue State For Taking Water Rights, State Judge Rules

Mealey's (October 2, 2015, 3:13 PM EDT) -- BEAVER CITY, Neb. — A Nebraska state court judge on Sept. 28 said three plaintiffs can proceed with their claims that Nebraska’s 2013 denial of water allocations from the Republican River basin constituted inverse condemnation, but he dismissed their claim that the state’s failure to regulate groundwater also constituted a taking of water rights (Greg Hill of Furnas County, et al. v. State of Nebraska, et al., No. CI14-68, Neb. Dist., Furnas Co.).
