(October 1, 2015, 11:45 AM EDT) -- WASHINGTON, D.C. — Review of a Second Circuit U.S. Court of Appeals’ ruling in a securities class action lawsuit is not necessary, defendants argue in a Sept. 17 opposition brief, because an investor has asked the U.S. Supreme Court to consider its question presented “without regard to the post-judgment posture of the case” (Boca Raton Firefighters and Police Pension Fund v. Robert J. Bahash, et al., No. 15-88, U.S. Sup.; 2015 U.S. S. Ct. Briefs LEXIS 3288).
