Judge Sends Issue Of Tribal Utility Regulation To Oglala Sioux Tribal Court

Mealey's (October 6, 2015, 11:23 AM EDT) -- SIOUX FALLS, S.D. — Following the policy of Congress “to promote tribal self-government,” a South Dakota federal judge on Sept. 25 stayed a lawsuit filed by AT&T Corp. seeking declaratory judgment regarding the rights of a tribal utility commission so the question of jurisdiction over telecommunications regulation can be decided in tribal court (AT&T Corp. v. Oglala Sioux Tribe Utility Commission, et al., No. 14-4150, D. S.D.; 2015 U.S. Dist. LEXIS 129071).
