New York Justice Dismisses Some Claims From Construction Defects Lawsuit

(October 1, 2015, 7:33 AM EDT) -- NEW YORK — A New York state court justice on Sept. 4 dismissed claims for breach of fiduciary duty and negligence per se asserted by plaintiffs in a construction defects lawsuit after finding that the breach of fiduciary duty claim was duplicative of the breach of contract claim and that the plaintiffs did not sufficiently allege a claim for negligence per se (Silverboys LLC, et al. v. Yianni Skordas, No. 653874/2014, N.Y. Sup., New York Co.; 2015 N.Y. Misc. LEXIS 3266).
