Insurer Has No Duty To Defend Insured For Wall Collapse, Federal Judge Says
(September 29, 2015, 12:26 PM EDT) -- SPOKANE, Wash. — An insurer has no duty to defend an insured seeking coverage for the collapse of a wall at a construction site because the policy clearly excludes coverage for property damages caused by an insured’s work or arising out of the insured’s operations, a Washington federal judge said Sept. 17 (Atlantic Casualty Insurance Co. v. Johnny’s Quality Exteriors Inc., et al., No. 14-03120, E.D. Wash.; 2015 U.S. Dist. LEXIS 128290).
