Judge: Retaliation Claim Against Town Related To Fracking Sign Valid

(September 25, 2015, 2:53 PM EDT) -- NEW YORK — A federal judge in New York on Aug. 6 ruled that a man who sued his town alleging that his First Amendment rights had been violated based on actions the town took to force him to remove a pro-hydraulic fracturing sign on his property had alleged a plausible claim for retaliation (Edward J. Lang v. Town of Tusten, N.Y., et al., No. 14CV4136, S.D. N.Y.; 2015 U.S. Dist. LEXIS 126856).
