Magistrate Judge Recommends Denying EPA’s Request For Immediate Access To School

(September 24, 2015, 3:56 PM EDT) -- PEORIA, Ill. — A federal magistrate judge in Illinois on Sept. 15 recommended against granting a motion filed by the federal government seeking immediate access to the site of a crumbling school building for the purpose of conducting a removal action, finding that there is not enough evidence that asbestos-containing material (ACM) in the building poses an imminent threat the human health and the environment (United States of America v. Donna Gearing, et al., No. 15CV01333, C.D. Ill.; 2015 U.S. Dist. LEXIS 126548).
