Judge Orders Arbitration, Stays Defendants’ Motion To Dismiss Claims

Mealey's (September 24, 2015, 9:45 AM EDT) -- WORCESTER, Mass. — A federal judge in Massachusetts on Sept. 22 granted a building designer’s motion to compel arbitration on its claims that a subcontractor defectively installed exterior sheeting, finding that the contract between the parties contained an arbitration clause and because the defendants were unable to show that the plaintiff waived the arbitration provisions (Cutler Associates Inc. v. Palace Construction LLC, et al., No. 15-40021-TSH, D. Mass.; 2015 U.S. Dist. LEXIS 126682).
