7th Circuit Finds 1920 Agreement Bars Company’s CERCLA Contribution Claim

Mealey's (September 23, 2015, 1:23 PM EDT) -- CHICAGO — A Seventh Circuit U.S. Court of Appeals panel on Sept. 21 upheld a federal judge in Illinois’ ruling finding that a 1920 agreement between a plaintiff company and the defendant’s predecessor barred the plaintiff’s claim for contribution under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Section 113(f) (Peoples Gas Light & Coke Company v. Beazer East Inc., No. 14-3634, 7th Cir.; 2015 U.S. App. LEXIS 16745).
