Insureds Cannot Present Evidence Of Mold Damage, Pennsylvania Federal Judge Says
Mealey's (September 22, 2015, 11:34 AM EDT) -- HARRISBURG, Pa. — Insureds are not permitted to present any evidence at trial related to their claim for mold damages because the insureds did not respond to the insurer’s motion to exclude the evidence and because the insurer would be prejudiced if the evidence is presented at trial, a Pennsylvania federal judge said Sept. 16 (Toni Sabol, et al. v. Allstate Property and Casualty Insurance Co., No. 11-0532, M.D. Pa.; 2015 U.S. Dist. LEXIS 123323).
