Judge: Question Exists On Whether Insured Gave Timely Notice Of Defects Claim
(September 16, 2015, 1:40 PM EDT) -- COLUMBUS, Ga. — A genuine factual dispute exists as to whether an insured provided its insurer with timely notice of an underlying construction defects claim against it, a Georgia federal judge ruled Sept. 15, denying summary judgment to the insurer (Owners Insurance Co. v. Nicole Lopez, et al., No. 14-290, M.D. Ga.; 2015 U.S. Dist. LEXIS 122301).
