Claimant Incorrectly Served Suit On Labor Secretary, Colorado Appeals Panel Says

(September 11, 2015, 10:14 AM EDT) -- DENVER — A disability claimant was not permitted to serve a complaint on the secretary of Labor because the administrator of the long-term disability plan was named in the policy’s summary plan description and the claimant was required to file suit against the insurer because the insurer was the only entity that was obligated to pay benefits under the plan at issue, the Second Division Colorado Court of Appeals said Aug. 13 (Caroline Burton v.
