Illinois Insurance Law Not Preempted By ERISA, 7th Circuit Panel Says

(September 11, 2015, 10:13 AM EDT) -- CHICAGO — The Employee Retirement Income Security Act does not preempt an Illinois insurance law that prohibits insurers from including a policy provision that allows an insurer to interpret the terms of the contract because ERISA does not preempt state laws that regulate insurance, the Seventh Circuit U.S. Court of Appeal said Sept. 4 in affirming a District Court’s ruling in favor of a disability claimant (Mary C. Fontaine v. Metropolitan Life Insurance Co., No. 14-1984, 7th Cir.; 2015 U.S. App. LEXIS 15818).
