8th Circuit Reverses Ruling In Insurer’s Favor In Suit Addressing Uberrimae Fidei

LOUIS — The Eighth Circuit U.S. Court of Appeals on Aug. 20 reversed a lower federal court’s finding that a marine insurance policy was void under the doctrine of uberrimae fidei, concluding that there are disputed issues of material fact as to whether the element of reliance was satisfied in a coverage dispute over the sinking of a leased barge during a nor’easter (St. Paul Fire & Marine Insurance Co. v.
