Judge: Misrepresentation Regarding Car’s Primary Use Warrants Policy Rescission

(August 26, 2015, 12:01 PM EDT) -- JONESBORO, Ark. — A man’s misrepresentation on an online application for an automobile insurance policy that he used his vehicle for work and school as opposed to business for the vehicle’s primary use allowed Nationwide Property & Casualty Insurance Co. to rescind the policy, a federal judge in Arkansas ruled Aug. 19 in granting the insurer’s motion for summary judgment (Nationwide Property & Casualty Insurance Company v. Donald R. Faircloth Jr., No. 13-cv-326-DPM, E.D. Ark.; 2015 U.S. Dist. LEXIS 109621).
