9th Circuit Finds RESPA And TILA Claims Are Time-Barred

(August 25, 2015, 10:17 AM EDT) -- PASADENA, Calif. — The Ninth Circuit U.S. Court of Appeals on Aug. 20 affirmed a district court's decision to dismiss numerous claims asserted by a borrower, including claims for violations of the Real Estate Settlement Procedures Act (RESPA) and the Truth in Lending Act (TILA), finding that he failed to state a claim or that the claims were time-barred (Kofi Obeng-Amponsah v. Chase Home Finance LLC, et al., No. 11-55397, 9th Cir.; 2015 U.S. App. LEXIS 14636).
