Trial Judge Finds Insurer Has No Subrogation Right To Recover Insured’s Costs

Mealey's (August 14, 2015, 12:03 PM EDT) -- NEW CASTLE, Del. — An insurer has no right of subrogation against a condominium unit owner and property manager regarding payments made for property damage sustained to the condominium building arising from the unit owner’s burst pipe, a Delaware trial judge ruled Aug. 5 (Scottsdale Insurance Co., as subrogee of The Tides Condominium Association of Owners v. Schell Properties, LLC and Sotheby's International Realty Affiliates, LLC, No. N15C-01-187 ALR, Del. Super., New Castle Co.; 2015 Del. Super. LEXIS 399).
