5th Circuit Affirms Award Entered In Insured’s Favor In Oil Spill Coverage Suit

Mealey's (August 12, 2015, 10:12 AM EDT) -- NEW ORLEANS — The Fifth Circuit U.S. Court of Appeals on July 30 upheld an award of more than $23 million in an insured’s favor for pollution cleanup costs incurred as a result of an oil spill in the wake of Hurricane Katrina on the basis that the district court did not err in setting the accrual date for the penalty interest award (Cox Operating LLC v. St. Paul Surplus Lines Insurance Co., No. 13-20509, 5th Cir.; 2015 U.S. App. LEXIS 13318)....
