Claimant Is Entitled To ‘Own Occupation’ Disability Benefits, Federal Judge Says

Mealey's (August 7, 2015, 9:36 AM EDT) -- SEATTLE — A disability claimant is entitled to “own occupation” disability benefits for the 18 months prescribed under a disability policy because it is clear from the evidence that the claimant’s disability makes it impossible to for her to perform the duties of her occupation, a Washington federal judge said July 27 (Joni Anderson v. Liberty Mutual Long Term Disability Plan, et al., No. 15-00145, W.D. Wash.; 2015 U.S. Dist. LEXIS 97837).
