3rd Circuit: Law Firm Lacks Standing To Sue FDA Over Citizen Petition Denial

Mealey's (October 11, 2016, 2:20 PM EDT) -- PHILADELPHIA — The Third Circuit U.S. Court of Appeals on Oct. 6 said a plaintiff’s law firm lacks standing to sue the Food and Drug Administration because the agency’s denial of the firm’s citizen petition to restrict the use of Risperdal in children is being used against it by defendant Janssen Pharmaceuticals Inc. (Sheller, P.C. v. United States Department of Health and Human Services, et al., No. 15-3443, 3rd Cir.; 2016 U.S. App. LEXIS 18188).
