Judge Affirms Federal Conviction Of Indian For Assault On Reservation

Mealey's (October 11, 2016, 11:39 AM EDT) -- MOSCOW, Idaho — A federal magistrate judge had jurisdiction when she found a Native American guilty of assault charges because the victims were not members of an Indian tribe and the tribe had not already punished the defendant for the crimes, an Idaho federal judge ruled Oct. 6 in affirming the convictions (United States of America v. Robert Wesley Warden, No. 3:13-po-00211, D. Idaho; 2016 U.S. Dist. LEXIS 139412).
