California Magistrate Judge Denies Remand Motion In Case Against Home Care Franchisor
Mealey's (October 7, 2016, 2:38 PM EDT) -- OAKLAND, Calif. — A California federal magistrate judge on Oct. 5 denied a motion to remand a franchise agreement dispute to state court because the two plaintiffs’ claims, which she ruled can be aggregated, exceed the $75,000 jurisdictional threshold to keep the case in federal court (John Han, et al. v. Synergy Homecare Franchising LLC, No. 16-cv-03759, N.D. Calif.; 2016 U.S. Dist. LEXIS 138675).
