Texas Supreme Court Won’t Rule Device Maker Is A Protected Health Care Provider

Mealey's (October 5, 2016, 11:00 AM EDT) -- AUSTIN, Texas — The Texas Supreme Court on Sept. 23 denied a petition by an orthopedic device maker to find that it is a health care provider entitled to tort reform protections under the Texas Medical Liability Act (TMLA) (Verticor, Ltd. v. Michael Wood, No. 15-0988, Texas Sup.).

Michael Wood was implanted with an Eclipse Sphere spinal implant made by Verticor Ltd.  The procedure, performed by Dr. James Hansen, is described as a “motion-sparing, non-fusion” spinal surgery.
