Judge Remands Suit Alleging Insurer’s Rate Cuts Violated ACA

Mealey's (July 17, 2015, 12:59 PM EDT) -- RICHMOND, Va. — A diagnostic services company’s suit contending that an insurer illegally lowered reimbursement rates is in essence a contract dispute, and neither the lofty nature nor nationwide reach of the Patient Protection and Affordable Care Act (ACA) creates federal jurisdiction, a Virginia federal judge held June 19 in remanding the case (Dominion Pathology Laboratories v. Anthem Health Plans of Virginia Inc., No. 15-152, E.D. Va.; 2015 U.S. Dist. LEXIS 80002).
