Missouri Panel: Pollution Exclusion Does Not Bar Coverage For Underlying Suits
Mealey's (September 30, 2016, 4:01 PM EDT) -- ST. LOUIS — The Eastern District of the Missouri Court of Appeals on Sept. 27 affirmed that a pollution exclusion cannot be used as a bar to coverage for underlying toxic tort claims because the exclusion, as used in the policy at issue, is ambiguous (The Doe Run Resources Corp. v. American Guarantee & Liability Insurance, et al., No. ED103026, Mo. App., Eastern Div., Div. 3; 2016 Mo. App. LEXIS 964).
