Kentucky High Court Finds No Error In Exclusion Of Testimony On Gender Transformation

(September 27, 2016, 10:46 AM EDT) -- FRANKFORT, Ky. — A trial judge did not err in excluding testimony of a victim’s alleged prior acts of violence and sexual misconduct or by barring a psychologist’s testimony regarding transgender identity transformation, the Kentucky Supreme Court ruled Sept. 22, upholding a murder conviction (Matthew Smith a/k/a Maddie Smith v. Commonwealth of Kentucky, No. 2015-SC000451-MR, Ky. Sup.; 2016 Ky. Unpub. LEXIS 73).
