Government Tells Judge ACA Birth-Control Mandate Class Lacks Commonality
Mealey's (June 11, 2015, 3:53 PM EDT) -- OKLAHOMA CITY — Any injunctive relief ruling in a challenge to the Patient Protection and Affordable Care Act (ACA)’s contraceptive mandate likely faces an appeal and should be addressed prior to a class certification motion, the government told an Oklahoma federal judge April 22, 2014. The government urged the judge to deny class certification should he address that issue first (The Catholic Benefits Association LCA, et al. v. Kathleen Sebelius, et al., No. 14-240, W.D. Okla.).
