Colorado Supreme Court: District Can Claim Credit For Wastewater Returns

Mealey's (July 14, 2015, 10:27 AM EDT) -- DENVER — The Colorado Supreme Court on June 22 affirmed a state water court’s ruling that a water district can claim credit for wastewater returns to a river basin and affirmed the awarding of attorney fees and costs against an intervenor district for pursuing “frivolous defenses” (Concerning the Application for Water Rights for Cherokee Metropolitan District in El Paso County, Colorado, Upper Black Squirrel Creek Ground Water Management District v. Cherokee Metropolitan District, et al., No. 13SA330, Colo. Sup.; 2015 Colo. LEXIS 535).
