Montana Supreme Court: Preliminary Injunction For Water Ditch Was Proper

(September 7, 2016, 12:21 PM EDT) -- HELENA, Mont. — The Montana Supreme Court on Aug. 23 said a trial court did not err when it issued a preliminary injunction that a property owner allow a neighbor access to a water ditch and said the ruling was in no way a final determination without benefit of a jury trial (Chriss Mack, et al. v. Jimmy Anderson, et al., No. DA 15-0600, Mont. Sup.; 2016 Mont. LEXIS 770).
