(August 23, 2016, 10:09 AM EDT) -- ALBUQUERQUE, N.M. — The Patient Protection and Affordable Care Act (ACA)’s risk adjustment program “brutally penalizes new, innovative, low-cost insurance companies” whose processes keep premiums low by making them subsidize larger, existing insurers, a nonprofit created under the law alleges in a July 29 complaint seeking declaratory and injunctive relief (New Mexico Health Connections, a New Mexico non-profit corporation v. United States Department of Health and Human Services, et al., No. 16-878, D. N.M.).
