Magistrate: Landowners Suffer Risk Of Irreparable Harm In Surface Rights Dispute
(August 8, 2016, 11:43 AM EDT) -- MUSKOGEE, Okla. — A federal magistrate judge in Oklahoma on May 23 denied a hydraulic fracturing company’s motion for declaratory judgment regarding its complaint that it should be permitted to construct a power line over the property of a landowner for the purpose of exploring for oil, concluding that the landowner suffered the risk of irreparable harm (XTO Energy Inc. v. Ray Whitmire, et al., No. 16-138, E.D. Okla.; 2016 U.S. Dist. LEXIS 101079).
