Company: Plaintiffs May Not File Fracking Case After Opting Out Of Class Action

(August 5, 2016, 2:00 PM EDT) -- HARRISBURG, Pa. — A hydraulic fracturing company on July 25 filed a brief in Pennsylvania federal court contending that a group of landowner plaintiffs is not permitted to sue the company for alleged breach of duty regarding royalty payments because those claims are the same ones asserted in a separate class action from which the plaintiffs in the case at hand opted out (Timothy Tyler, et al. v. Chesapeake Appalachia LLC, No. 16-00456, M.D. Pa.).
