DOL Supports Petitioner Opposing Disability Plan’s Forum-Selection Clause

(August 4, 2016, 3:48 PM EDT) -- ST. LOUIS — The U.S. Department of Labor (DOL) on June 16 filed an amicus brief in the Eighth Circuit U.S. Court of Appeals in support of a plan participant, saying that a disability plan’s forum-selection clause deprives her of the choices afforded by the Employee Retirement Income Security Act’s venue provision and requires her to bring suit at a considerable distance from her home (In re Lorna Clause, No. 16-2607, 8th Cir.).
