Cherokee Nation Employee Appeals Dismissal Of Suit To Tribe’s High Court

(July 27, 2016, 4:18 PM EDT) -- TAHLEQUAH, Okla. — A Cherokee Nation employee on July 19 appealed the dismissal of his constructive discharge claims against the tribe to the Cherokee Nation Supreme Court, arguing that the tribal officials involved are not protected by the tribe’s sovereign immunity because they are subject to suit in their official capacities for injunctive and declaratory relief (David Comingdeer v. Cherokee Nation, et al., No. SC-16-07, Cherokee Nation Sup.).
