Sprint Fidelis Claims Based On Post-Recall Statements Are Preempted, Judge Says
(July 27, 2016, 10:04 AM EDT) -- AUSTIN, Texas — A Texas federal judge on June 29 dismissed with prejudice a plaintiff’s claims that post-recall communications by Medtronic Inc. contributed to her husband’s later death from a fractured Sprint Fidelis heart lead (Carolyn Green Gates, et al. v. Medtronic, Inc., No. 15-729, W.D. Texas, Austin Div.; 2016 U.S. Dist. LEXIS 92549).
